Notice of Continuation of Hearing Development Charge and Education Development Charge Complaint – Wye Heritage Marine Resort
THE CORPORATION OF THE TOWNSHIP OF TAY
TAKE NOTICE that Pursuant to Section 20(1) of the Development Charges Act, and Section 257.85 of the Education Act, the Council of the Corporation of the Township of Tay has scheduled a Continuation of Hearing to receive comments regarding a complaint received with respect to Development Charges for the Wye Heritage Marine Resort located at 3282 Ogdens Beach Road, Port McNicoll.
Development Charges Act
20(1) A person required to pay a development charge, or the person’s agent, may complain to the Council of the municipality imposing the development charge that:
(a) the amount of the development charge was incorrectly determined;
(b) whether a credit is available to be used against the development charge, or the amount of the credit or the service with respect to which the credit was given, was incorrectly determined; or
(c) there was an error in the application of the Development Charges By-law.
Education Act
257.85(1) An owner, the owner’s agent or a board, may complain to the council of the municipality to which an education development charge is payable that,
(a) the amount of the education development charge was incorrectly determined;
(b) a credit is or is not available to be used against the education development charge, or that the amount of a credit was incorrectly determined; or
(c) there was an error in the application of the education development charge by-law.
AND FURTHER TAKE NOTICE that the continuation of hearing is scheduled to be held in-person on the 23rd day of September 2026, at 2:00 p.m. At this time, Council will hear comments from the complainant, and all interested parties who wish to speak on the matter. The complainant and all interested parties are required to submit their written comments and submissions to Katelyn Johns, Municipal Clerk/Library CEO kjohns@tay.ca by Wednesday, September 16, 2026, for inclusion on the Public Agenda.
