Notice of Passing of an Amendment to the General Zoning By-law

Take Notice that the Council of the Corporation of the Township of Tay passed By-law 2019-72 on the 23rd day of October, 2019, pursuant to Section 34 of the Planning Act, R.S.O. 1990, being an amendment to Zoning By-law 2000-57.

The Lands Subject to the Amendment are the lands described as Part Lot 2, Reference Plan 51R-30220, Part of Lot 15, Concession 12 and municipally known as 161 Gerhardt Road as indicated on the key map attached to the news item at tay.ca/news.

The Purpose and Effect of the Zoning By-law Amendment: That Schedule “N” to General Zoning By-law No. 2000-57 is hereby further amended by rezoning those lands described as Part Lot 2, Reference Plan 51R-30220, Part of Lot 15, Concession 12 and municipally known as 161 Gerhardt Road, from Limited Service Residential Hold (LSR-H) Zone to Limited Service Residential Exception Eight "LSR-8" Zone, as shown on amended Schedule "A".

The Complete Zoning By-law Amendment is available for inspection between 8:30 a.m. and 4:30 p.m. in the Planning Department in the Municipal Building, 450 Park Street, Victoria Harbour, Ontario, L0K 2A0.

Correspondence Received from the public and external agencies on the proposed amendment were summarized and included in the Planning and Development Department Report (PD-2019-31) for the Public Meeting on June 26th, 2019. Comments received after the public meeting were summarized and considered in the preparation of the final Zoning By-law and are included in the Public Meeting section of the Planning and Development Report (PD-2019-42) dated September 11th, 2019.

Appeals: Any appeals of the zoning by-law amendment must be filed with Alison Gray, Municipal Clerk, 450 Park Street, Victoria Harbour, Ontario, L0X 2A0, on or before the 18th day of November, 2019,setting out the reasons for the appeal together with a certified cheque or money order in the amount of $300.00, payable to the Minister of Finance. Please refer to the Tribunal website for the Appellant Form (A1) and more information on filing an appeal.

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal there are reasonable grounds to add the person or public body as a party.
