NOTICE OF COMPLETE APPLICATION AND NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT FOR 36 HAZEL STREET, WAUBAUSHENE, TOWNSHIP OF TAY

Take Notice The Corporation of the Township of Tay has received a complete application from Innovative Planning Solutions, on behalf of 2780827 Ontario Inc., owner of 36 Hazel Street, and will be holding a Public Meeting electronically on Wednesday November 25th at 6:30 PM to consider amendment to the Township’s Zoning By-law 2000-57, as amended pursuant to Section 34 of the Planning Act, R.S.O. 1990, c.P.13 as amended. The Council Meeting will be streamed live via Zoom meetings at www.tay.ca/MeetingsPlease note that there may be more than one public meeting and that the matter will be dealt with in the order it appears on the agenda.

The Purpose and Effect of the Zoning By-law Amendment:

The application proposes to define and add “Private Career College” as a site specific permitted use on the subject lands, which are presently zoned Institutional. The inclusion of this new defined use is to facilitate the lands to be used for a Firefighting Training and Education facility. The applicant is proposing that there be no live fire burning permitted at this location.

The proposed definition for Private Career College would be:

Private Career College shall mean a private career college as defined under the Private Career Colleges Act 2005, S.O. 2005, c. 28, Sched. L, and any successor thereto.  

The applicant is also proposing that accessory uses for a Private Career College include accessory overnight accommodations for a maximum of 15 (fifteen) consecutive nights.

In addition, the application also proposes the following additional site specifics:

Accessory Buildings, Uses and Structures: Maximum Height (Section 4.1.7)

a) A maximum height for one detached accessory structure of 12.0 metres.

Motor Vehicles, Not in Running Order (Section 4.14)

b) Where a Private Career College exists, the temporary parking and outdoor storage of any vehicle that is not in running order but used for training purposes will be permitted;

Prohibited Uses (Section 4.22)

c) Where a Private Career College exists, the outdoor storage of a decommissioned railroad car will be permitted for training purposes, whether or not the railroad car is situated on a foundation; 

Parking Requirements by Use (Section 5.3)

d) A minimum of 37 off-street parking spaces will be permitted for a Private Career College.

Submissions received will form part of the public record, including the name and address of those making submissions. If you wish to be notified of Council’s decision regarding the proposed Amendment to the Zoning By-law, you must submit a written request to Steve Farquharson at the address shown above.

If a person or public body does not make oral submissions at the public meeting or make written submissions to the Township of Tay before the proposed Amendment to the Zoning By-law is passed, the person or public body is not entitled to appeal the decision of the Council of the Township of Tay to the Local Planning Appeal Tribunal and the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
