Tax Sales

Properties that are three or more years in arrears in payment of their property taxes become eligible for the initiation of tax sale proceedings. The Municipality will register a Tax Arrears Certificate, which indicates that the property will be sold if the cancellation price is not paid in full within one year of registration. Once a Tax Arrears Certificate has been registered on title, partial payments cannot be accepted unless there is an Extension Agreement in effect.

The property owner or other individual receiving notice of the tax arrears certificate may, during the one-year redemption period, pay the outstanding taxes, interest and costs and request a cancellation of the certificate. If the Cancellation Price is not paid within one year of registration, the Municipality may then advertise the property for public sale for non-payment of taxes. Advertisements are published on the Township of Tay website and on www.ontariotaxsales.ca for four consecutive weeks and in the Ontario Gazette for one week.

The process of a tax sale follows the Municipal Act which determines the timing of notices that must be sent and whether or not registered mail must be used. At each step of the process, administrative fees, legal fees, and other costs are added to the cancellation price. The process takes one year from the time the tax arrears certificate is registered on the property title to the time that the municipality can offer the property for public sale.

Information for Bidders

Tax Sales are not typical real estate transactions. It is not the Municipality's responsibility to verify the accuracy of the data particularly since much of it is collected from the assessment records. If you are considering participating in a tax sale, it is highly recommended that you seek independent legal advice from a lawyer licensed to practice in Ontario and in good standing with the Law Society of Upper Canada.

  • You are responsible for conducting a title search at your own expense to find out if there is a mortgage or any liens against the property.
  • The Township of Tay cannot provide you with access to view the property.
  • Properties are sold “as is,” meaning the Township will not make repairs or improvements before or after the tax sale.
  • The Township will not remove any debris or personal belongings left on the property or cover any of the associated costs.
  • The Township does not guarantee vacant possession of the property.
  • The Township does not have information about annual utility costs for any of the properties.
  • A property will be removed from the tax sale if the current owner pays the cancellation price before the property is transferred to a successful bidder or vested in the Township.
    • A cancellation price is the total amount owed for unpaid taxes on the property. This can include tax arrears, current property taxes, interest, penalties and any reasonable costs incurred by the Township after a Tax Arrears Certificate is registered under section 371 of the Municipal Act, 2001.
  • You may bid on more than one property.
  • If you bid on more than one property, you must submit the bids in separate envelopes for each property. Combined bids in one envelope will be rejected.
  • Tender package documents can be purchased online for a non-refundable fee of $30 plus HST.
  • You must provide at least 20% of the tender amount with a completed form in a sealed envelope.
  • The sealed envelope must be received at Tay Township no later than 3pm on November 26, 2025.
  • The sealed envelope must specify the property you are bidding for in the space provided on the envelope included in the tender package.
  • If you are not the highest bidder, you will receive your deposit cheque back by registered mail after the property tax sale event.
  • If the highest bidder does not follow through, the Township will offer the property to the second-highest qualified bidder.
  • You will receive a notification by registered mail within one week after the property tax sale event.
  • If you want a family member or lawyer to get the notification instead, you must provide a Letter of Authorization that includes the following by emailing taxinfo@tay.ca or placing it in the drop box outside Town Hall at the north entrance:
    • Property details (address or roll number)
    • Name of the person being authorized
    • Tenderer’s signature
  • You must pay the balance due within 14 calendar days of the notice.
  • You must make the payment payable to The Corporation of the Township of Tay.
  • You may submit the tender funds through someone who is properly authorized to do so.
  • The Township does not have or provide keys to the property.
  • You are responsible for additional taxes, charges, penalties, and interest that may be owed after the property is advertised for sale, as well as land transfer taxes, registration fees, and HST (if applicable).
  • You are responsible for any mortgages or liens on the property.
